Update: April 20th, 2018 

Discussion from the Health and Human Services Committee. Senator Abeler, Benson and Chris Eaton talk about bill SF 2505 Pain Management Amendment. The support and comments from other legislators is much appreciated and informative.

After a week of hard work in the House Health and Human Services Finance Committee and the Senate Health and Human Service Finance and Policy Committee we achieved success in getting our Pain Management Amendment language into the Senate Health and Human Services omnibus bill SF2505.

Thanks to the very hard lifting of Senator Abeler and Representative Glenn Gruenhagen we were able to finally craft the language that was acceptable to Senator Benson to adopted the SF2505-A19 amendment offered by Senator Abeler.

Senator Scott Jensen, Senator Mary Kiffmeyer, Senator Melissa Wiklund and Senator Chris Eaton all spoke in favor of the amendment. Senator Benson spoke in favor and said if this costs money she would find the money in the budget to see that it is implemented.

This amendment was passed on a unanimous vote of all committee members. The language will now be in the Conference Committee on the Senate side.

Unfortunately the massage therapy and other unlicensed groups listed in the HF2389 amendment were removed at the insistence of Senator Benson and osteopathic physicians and advanced practice registered nurses licensed under Chapter 148.171 were added.

Reducing or elimination chronic pain was added to the bill language.

Prior House Action on HF 2389.

Following the House Vote on HF2389 passage to be considered for inclusion in the House Omnibus bill HF 3138, Rep. Gruenhagen, Chuck Sawyer and I met with DHS staff to craft language that DHS recommended to make the bill workable and retain the elimination of the fiscal note for when the Senate considered the HF2389 amendment language in the Senate.

Rep. Gruenhagen asked Senator Dean if he plan to include the HF2389 amended language and we learned he was not willing to do that. Over the next couple days we made numerous efforts to get the HF 2389 language into the House Omnibus bill, including preparing the revised Senate language as a amendment, as the hearing on the omnibus bill was going on, but to no avail.

Next Steps 

The House and Senate will be debating and passing the two Omnibus bills next week. Once again the bills will go to a Conference Committee. With the strong commitment of Senator Benson, we hope to prevail as the conference committee language is adopted.
